1. Introduction
a. The Vergenoeg Application Portal is exclusively hosted by RMG Forensic Services (Pty) Ltd hereafter referred to as RMG or the Service Provider. The Vergenoeg Application Portal is owned and operated by RMG ("the Service Provider") on behalf of Vergenoeg Mining Company ("the Client").
b. Users will be defined as all users that include those appointed by the Service Provider or the Client to perform administrative functions. All users are subject to the data protection policies that are enforced by the Service Provider under the Protection of Personal Information Act nr 4 of 2013 hereafter referred to as POPIA.
c. The Vergenoeg Application Portal is designed for users to apply for bursaries, learnerships and donations that is approved at the discretion of the client. The Vergenoeg Application Portal also enables users to apply for Job Openings that are listed by the Client.
d. Users can be removed from accessing the Vergenoeg Application Portal at the discretion of the Client without prior notice.
2. Acceptance of Terms
a. All users are required to accept this Terms and Conditions of Service of the Vergenoeg Application Portal before any interaction with the Vergenoeg Application Portal will be allowed. Any users who have not accepted the Terms and Conditions of Service agreement will be held in contravention of the Terms and Conditions of Service Agreement and will have their access terminated.
b. All user submissions that do not include a completed and signed consent form will have their access to the Vergenoeg Application Portal terminated at the discretion of the Client.
c. All users are responsible for the information that is submitted in terms of correctness, accuracy and validity. All information that is submitted and needs to be corrected or updated must be brought under the attention of RMG or the Client.
3. Use of Vergenoeg Application Portal
a. By accessing the Vergenoeg Application Portal, you warrant and represent that your use of the Vergenoeg Application Portal is for lawful purposes and that you are over 18 years of age and can legally conclude a binding agreement with us.
b. You further warrant that you will not contravene any South African or International laws by using the Vergenoeg Application Portal.
c. Except as expressly authorised by the Service Provider or the Client, you may not use, alter, copy, distribute, or transmit the content of the Vergenoeg Application Portal.
4. Use of Information
a. The Service Provider and the Client conducts its business in accordance with South African legislation affecting its business. We value the privacy of your information and will protect your personal information in accordance with all relevant laws and regulations of South Africa. This includes POPIA and its regulations.
b. By accepting these terms and conditions, you expressly acknowledge, agree and consent to us using your confidential personal information (including but not limited to, names, addresses, identifying numbers and contact details) in order to provide the Service.
5. Important Notices
a. RMG takes all reasonable steps to safeguard data that is in its care and is fully compliant with the recommendations of POPIA. RMG takes all reasonable steps to ensure that the portal has minimal downtime and that errors are followed up. Should users experience errors that are not reported to the client or RMG, neither party shall be held responsible for non-submission of service.
b. RMG makes no guarantee or representation that the information or files available on the Vergenoeg Application Portal is free of viruses, spyware, malware, trojans, or destructive materials, however, RMG takes reasonable steps to ensure the integrity and cybersecurity of the systems under its stewardship.
6. Purpose of use of the site
The Vergenoeg Application Porta I will only be used for the purpose that it was designed in the first place namely to enable individuals to register and apply for learnerships, bursaries, donations and to make job applications. User conduct is expected to be professional, and all reasonable steps have been taken by RMG and the client to ensure that responsible and ethical individuals have been appointed to manage the Vergenoeg Application Portal. Any users that act in contravention to this expected behavior may have their access to the Vergenoeg Application Portal terminated at the discretion of the Client.
7. Amendment of Terms and Conditions
We reserve the right, in our sole discretion, to amend these terms and conditions at any time and without notice. Any such amendments wilt come into effect immediately and automatically. If we do this, we will post the amended terms and conditions on this page and indicate at the bottom of the page the date the terms and conditions were last revised. You agree to review these terms and conditions whenever you visit the site for any such amendments. If you do not agree to any of these terms and conditions do not use or access (or continue to access) this service.
